Waiting List?!? - We no longer actively use a waiting list, we now practice “first come, first serve”.

What is a deposit? - A deposit is basically a down payment for a chinchilla. The deposit is non-refundable. When you make this down payment I am promising to hold a chin under your name, so that you can purchase him/her when ready to be separated from his/her mother.
A deposit is also to protect the seller. This way, if you back out of the sale at any given time, all monies are returned minus the deposit. This compensates the breeder for time that chinchilla was taken off the market, and feeding/housing within that time.

How much is a deposit? - Deposit of $50.00 for chins sold for $200 or below, $100 for chins sold over $200, and $150 for chins sold over $350.

When can I make a deposit? - I will not accept a deposit for a chin until I send out the available list of babies. Once a deposit is made, kit will be *Sale Pending. If the full balance isn't received within the time that the kit is ready to go into a new home (10 weeks old) ,the kit will be considered *For Sale again.
Do not send deposit without first verifying with me that I will sell to you. I screen all potential buyers first before accepting any monies. This is to help ensure good homes.

Do I get any chin I want with this deposit? - Everyone is indeed after a specific color of chinchilla. I’m trying to increase my herd and the color quality of my herd, so I will not post available chins until they are officially available. I will always have first choice.

Can I get my deposit back? - All deposits are non-refundable. Please be certain that this is what you want. All the money I take in is used to make purchases for my herd; therefore, it will not be made available to you if for some reason you change your mind a week later.
If you have paid full balance on a chinchilla, then decide for whatever reason you do not want it (before pick up or shipping), all monies will be paid in full, minus deposit.

BUYER BACKOUT (Shipping)

To ship chinchillas, Buyer must have full amount paid on chinchilla(s), and shipping cost, plus the cost of health certificate ($35.00), and Shipping Crate ($30.00). This is to be paid before shipping date. If buyer backs out 10 days before shipment, buyer does not get refund on health certificate, or shipping crate. Just refund on chinchilla, and shipping cost, minus the deposit.
Sometimes I will send out my own shipping crate which I would like returned. In these cases you will send me the $30 and it will be returned to you after shipment if you return by mail the crate to me.

SELL OF POSSIBLE PREGNANT CHINCHILLAS:

If an adult female chinchilla is sold that has been a part of Eyes Of Texas Chinchillas breeding program. The buyer must agree that if the chinchilla gives birth to kits within 111 days from sale date, that he/she either gives kits to seller, or pay the seller half the price of each kit sold.

The ownership and responsibility of the chinchilla belongs solely to the buyer, but the seller unconditionally retains the Right to First Refusal. If for any reason the buyer cannot keep the chinchilla or decides to sell the chinchilla, the buyer will first contact the seller regarding placement of that chinchilla into a new home. Seller retains the right to assist the placement process and may request the contact information be exchanged with new owner. Seller may take chinchilla back from buyer if buyer can no longer care for the chinchilla, or chinchilla does not work out to buyers advantage. This would be at buyers expense, no refunds or exchanges are made for this type of transaction.

Chinchillas are typically friendly and the seller makes every attempt to provide information regarding full temperament and background upfront. However, no one can predict how a chinchilla will react in any given situation. Therefore, the buyer is urged to exercise prudence and caution when introducing the chinchilla into a new situation until the chinchilla has become fully adjusted to its new environment and the buyer has had an opportunity to become familiar with the chinchillas unique personality.

The seller shall not be responsible for any bodily injuries or property damage caused by the buyer’s chinchilla or the actions of the buyer. The buyer hereby specifically assumes sole responsibility for, and agrees to hold the seller harmless from any and all loss and expenses (including legal fees) by reason of liability imposed by law upon the seller because of bodily injuries or death to any person or persons including the buyer, or any damage to property arising out of or in consequence of the placement of the chinchilla, howsoever such injuries, death or damage to property may be caused, whether or not the same may have been caused, or may be alleged to have been accused, by negligence of the aforementioned parties or any of their employees, agents or members, or any other person.

Eyes Of Texas Chinchilla’s warranty obligations are limited to terms set forth: If a chinchilla suffers a health condition at the fault of the seller, as proven by the written notice of a competent veterinarian or the seller’s own examination, within the first 30 days following the date of the original sale, a refund or exchange will be issued to the buyer. At its option Eyes Of Texas Chinchillas will, within six months of the incidence, (1) replace the chinchilla with a chinchilla of equal or lesser value, (2) refund a percentage of the purchase price, (3) refund the full purchase price. Live chinchillas must be returned to the seller for an evaluation to qualify for a refund or exchange. When a chinchilla is exchanged, the new chinchilla issued by the seller becomes the property of the buyer and the exchanged chinchilla becomes the property of the seller. If death occurs, buyer must present seller with proof of death such as, but not limited to, the written notice of a veterinarian whose contact information must be provided to the seller. If an autopsy is performed by a veterinarian of the buyers choice, it is at the expense of the buyer.

THE WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED, EYES OF TEXAS CHINCHILLAS DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF EYES OF TEXAS CHINCHILLAS CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY. EYES OF TEXAS CHINCHILLAS IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOST PROFITS, GOODWILL, DAMAGE TO OR REPLACEMENT OF PROPERTY.
